Introductory Provisions

Internet shop PMMP Energy, available at the internet address https://pmmpenergy.com/sklep/, is run by Piotr Michalak, operating under the name Dreo Sp. z o. o., entered into KRS at the number: 0000965983, Tax Identification Number: 113-305-57-62 REGON:521734701

Present Statute It is aimed at both Consumers, as well as to Entrepreneurs using the Store and specifies the rules for using the Online Store and the rules and procedure for concluding contracts Sales Agreements with the Customer remotely via the Store.

Definitions

  • Consumer – a natural person concluding an agreement with the Seller within the Store, the subject of which is not directly related to his or her business or professional activity.
  • Seller - Dreo Sp. z o. o., entered into KRS at the number: 0000965983, Tax Identification Number: 113-305-57-62.
  • Client – any entity making purchases through the Store.
  • Entrepreneur – a natural person, a legal person and an organizational unit that is not a legal person, to which a separate act of law grants legal capacity, conducting business activities on its own behalf and using the Store.
  • Store – online store run by the Seller at the Internet address https://pmmpenergy.com/sklep/.
  • Contract concluded at a distance – an agreement concluded with the Customer as part of an organised system of concluding distance contracts (within the Shop), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication until the conclusion of the agreement.
  • Statute – these Store regulations.
  • Order – the Client's declaration of will submitted by means of Order Form and aiming directly at concluding Sales Agreements Product or Products with the Seller.
  • Account – customer account in the Store, which collects data provided by the Customer and information about Orders placed by him in the Store.
  • Registration form – a form available in the Store, enabling the creation of Accounts.
  • Order form – interactive form available in the Store enabling the submission of Orders, in particular by adding Products to Basket and defining the conditions Sales Agreements, including delivery and payment methods.
  • Basket – an element of the Store software, which shows the Products selected by the Customer for purchase, and it is also possible to determine and modify data Orders, especially the quantity of products.
  • Product – a movable item/service available in the Store that is the subject of Sales Agreements between the Customer and the Seller.
  • Sales Agreement – a Product sales agreement concluded or entered into between the Customer and the Seller via the Online Store. By Sales Agreement also understood – applying to the features of the Product – as a contract for the provision of services and a contract for specific work.

The seller has the right to cancel the order if it is impossible to fulfill the order.

The Customer may communicate with the Seller using the addresses and telephone numbers provided in this section.
The Customer may communicate with the Seller by phone during business hours 9:00 – 16:00.


Technical requirements

To use the Store, including browsing the Store's assortment and placing orders for Products, you must:

  • A terminal device with access to the Internet and a web browser (computer, laptop, telephone, tablet).
  • Active electronic mail (e-mail) account.
  • Cookies are enabled.

General information

  • The Seller shall not be liable to the fullest extent permitted by law for any disruptions, including interruptions in the functioning of the Store caused by: higher power, unauthorized actions of third parties or incompatibility of the Online Store with the Customer's technical infrastructure.
  • Browsing the Store's assortment does not require creating an Account. Placing orders by the Customer for Products in the Store's assortment is possible either after creating an account in accordance with the provisions of § 6 of the Regulations, or by providing the necessary information personal and address data enabling the execution of the Order without creating an account.
  • Prices given in the Store are in Polish zloty and are gross prices. (includes VAT).
  • On final (final) amount to be paid by the Client consists of Price for Product and shipping cost (including transport, delivery and postal fees), about which the Customer is informed on the Store's website when placing an Order, including when expressing the will to be bound by Sales Agreement.
  • In case of Agreement covering subscription or provision of services for an indefinite period, the final (final) price is total price including all payments for the billing period.
  • When the nature of the subject of the Agreement does not allow, judging reasonably, for a prior calculation of the amount final (final) price, information about the way the price will be calculated and also about transport, delivery, postal and other costs, will be given in the Store in the Product description.

Creating an Account in the Store

To create an Account in the Store, please fill out Registration form. It is necessary to provide the following data:

  • Name and surname
  • Exact address
  • Email address
  • Phone number
  • Login
  • Password

Creating an Account in the Store is free.

Logging in to the Account is done by providing: login and password established in Registration form.

The customer has the option at any time, without giving a reason and without incurring any fees delete your Account by sending an appropriate requests to the Seller, in particular through by e-mail or in writing to the addresses given in § 3.


Rules for placing an order

For the purpose of placing an order you should:

  1. Select Product which is the subject of the Order, and then click the button "Add to cart" (or equivalent).
  2. Log in or take advantage of the opportunity placing an order without registration.
  3. If selected possibility of placing an Order without registration - to fill in Order form, by typing:
    • Order recipient details and address, on which the Product is to be delivered.
    • Type of shipment (method of delivery of the Product).
    • Invoice details, if different from the details of the Order recipient.
  4. Click the button "I order and pay".
  5. To choose one of the available payment methods and depending on the payment method, pay for the order within a specified period, subject to § 8 point 3.

Offered delivery and payment methods

The Customer may use the following methods of delivery or collection of the ordered Product:

  • Delivery man
  • Parcel locker

The customer can use the following payment methods:

  • Payments by bank transfer
  • Electronic payments
  • Payments by payment card
  • BLIK

Execution of the sales contract

  • Conclusion of the Sales Agreement between the Customer and the Seller takes place after prior the Customer places an Order by means of Order form in the Online Store in accordance with § 7 of the Regulations.
  • After placing an order The seller immediately confirms its receipt and at the same time accepts the Order for execution.
  • Confirmation of receipt of the Order and its acceptance for execution takes place by sending an appropriate e-mail message to the Customer by the Seller to the e-mail address provided when placing the Order Customer's e-mail address, which includes at least:
    • Seller's declaration of Receiving the Order
    • Seller's declaration of its acceptance for implementation
    • Confirmation conclusion of the Sales Agreement

WITH upon receipt by the Client of the above e-mail message it stays concluded Sales Agreement between the Customer and the Seller.


Payment Terms

In case of selection by the Customer:

  • Payments by bank transfer, electronic payments or payment by card - The customer is obliged to make payment within 7 calendar days from the date of conclusion of the Sales Agreement - otherwise the order will be canceled.

Delivery Terms

  • After selecting the delivery method, The product will be shipped by the Seller within the time specified in its description (subject to paragraph 5 of this section), in the manner selected by the Customer when placing the Order.
  • In case of Orders for Products with different delivery dates, the delivery date is the longest given term.
  • The customer has the option requests for delivery of Products in parts or delivery of all Products after completing the entire order.

The beginning of the delivery period of the Product to the Customer is counted as follows:

  • In case of payments by bank transfer, electronic payments or payment cards - From the day of crediting the Seller's bank account.

Personal collection

  • In case of selection by the Customer personal collection of the Product, The product will be ready for collection by the Client within the time specified in Product description.
  • ABOUT Product readiness for collection The customer will be additionally informed by the Seller by sending an appropriate e-mail message to Customer's e-mail address provided when placing the Order.
  • In case of Orders for Products with different readiness dates for collection, The customer has the option to:
    • Collection of Products in Parts (depending on their readiness for collection)
    • Collection of all Products after the entire order has been completed

The beginning of the period of readiness of the Product for collection by the Customer is counted as follows:

  • In case of payments by bank transfer, electronic payments or payment cards - From the day of crediting the Seller's bank account.

Shipping costs

  • Delivery of the Product takes place within the European Union.
  • Delivery of the Product to the Customer is subject to payment., unless The Sales Agreement provides otherwise.
  • Product delivery costs (including transport, delivery and postal charges) are indicated to the Customer on the pages Online store in the tab "Shipping costs" and during placing an order, including at the moment the Customer's expression of will to be bound by the Sales Agreement.
  • Personal collection of the Product by the Customer is free of charge.

Right of withdrawal

The consumer may, within the time limit 14 days withdraw from the Sales Agreement without giving any reason.

  1. The period specified in paragraph 1 begins upon delivery of the Product to the Consumer or a person indicated by him other than the carrier.
  2. In the case of a Contract that includes many products, which are delivered separately, in batches or in parts, the period specified in paragraph 1 runs from the delivery of the last item, batch or part.
  3. In the case of a Contract which involves regular delivery of Products for a specified period of time (subscription), the period specified in paragraph 1 runs from the moment of taking possession of the first item.

How to Withdraw from the Agreement

  • The Consumer may withdraw from the Agreement, by submitting a declaration of withdrawal from the Agreement to the Seller.
  • To meet the deadline for withdrawal from the Agreement just send by the Consumer before the expiry of this period.
  • The statement can be sent:
    • By traditional mail
    • By electronic means by sending a declaration to the Seller's e-mail address or by submitting a declaration on the Seller's website - the Seller's contact details are specified in § 3.
    • The declaration can also be submitted on form, the template of which constitutes Annex No. 1 to these Regulations and Annex to Act of 30 May 2014 on consumer rights, however, it is not mandatory.
  • In the event that the Consumer sends the declaration electronically, the Seller will immediately send it to the Consumer to the e-mail address provided by the Consumer confirmation of receipt of the statement on withdrawal from the Agreement.

Consequences of withdrawal from the Agreement

  1. In the event of withdrawal from the Contract concluded at a distance The contract is deemed not to have been concluded..
  2. In the event of withdrawal from the Agreement, the Seller shall return the money to the Consumer immediately, no later than within 14 days from the date of receipt of the Consumer's declaration of withdrawal from the Agreement, all payments made by him, including the costs of delivering the goods, with the exception of additional costs resulting from the Consumer's choice of a delivery method other than the cheapest standard delivery method offered by the Seller.
  3. Refund of payment The seller will make use of the same payment methodsthat were used by the Consumer in the original transaction, unless the Consumer has expressly agreed to another solution, which it will not involve any costs for him.
  4. The seller can withhold the refund until the Product is received back or until proof of its return is provided, depending on which event occurs first.

Product Return

  • The consumer should return the Product to the Seller's address given in these Regulations immediately, no later than 14 days from the date on which he informed the Seller of his withdrawal from the Agreement.
  • The deadline will be met, if the Consumer returns the Product before the 14-day period expires.
  • Consumer bears the direct costs of returning the Product, including the costs of returning the Product if, due to its nature, the Product could not be returned by regular post.
  • Consumer is only responsible for reducing the value of the Product resulting from using it in a way other than necessary to establish the nature, characteristics and functioning of the Product.

No right of withdrawal

Right of withdrawal is not available to the Consumer, If:

  • Product was made to individual order of the Consumer.
  • The product has been delivered in a sealed package, which after opening cannot be returned for hygiene or health protection reasons.
  • The product is subject to spoils quickly or has a short shelf life.
  • The service has been fully executed with the consent of the Consumer before the withdrawal deadline expires.
  • Price or salary depends on financial market fluctuations, over which the Seller has no influence.
  • Product was inextricably linked with other things after delivery.
  • This applies to alcoholic beverages, which have a specific delivery date and are subject to market price fluctuations.
  • This applies to a sound, visual or computer program recording delivered in a sealed package.
  • This applies to delivery of newspapers, periodicals or magazines, except subscriptions.
  • This applies to digital content, which are not recorded on a material medium, and their provision has begun with the express consent of the Consumer.

Complaint and warranty

  1. The Sales Agreement covers new products.
  2. The seller is obliged deliver to the Customer an item free from defects.
  3. In case of occurrence defects of the purchased goods, The customer has the right to complaints based on the provisions regarding warranty in the Civil Code.
  4. If the Customer is an Entrepreneur, the parties exclude liability under warranty.

How to file a complaint

  • The complaint should be filed in writing or electronically to the addresses of the Seller provided in these Regulations or using electronic complaint form made available by the Seller on one of the Store’s subpages.
  • It is recommended that the complaint include, among others:
    • A brief description of the defect
    • The circumstances of its occurrence (including the date)
    • Details of the Customer submitting the complaint
    • Customer's request regarding a product defect

Complaint handling time

  • The seller will respond to the complaint request immediately, no later than within 14 days.
  • If the Seller will not respond within this time frame, it is considered that the Customer's request has been recognized as justified.

Guarantee

  • If a warranty has been granted for the Product, information about it and its content will be included in the Product description in the Store.

Extrajudicial methods of handling complaints and pursuing claims

Detailed information on the possibility of using out-of-court complaint and claim settlement procedures by the Consumer and the rules of access to these procedures are available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Voivodship Inspectorates of Trade Inspection and at the following websites of the Office of Competition and Consumer Protection:

The consumer has the following examples of possibilities to use out-of-court methods of handling complaints and pursuing claims:

  • The Consumer is entitled to refer to a permanent consumer arbitration court, referred to in Art. 37 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to resolve a dispute arising from the Agreement concluded with the Seller.
  • The Consumer is entitled to contact the provincial inspector of the Trade Inspection, in accordance with Art. 36 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings on the amicable settlement of the dispute between the Consumer and the Seller.
  • The consumer may obtain free assistance in resolving a dispute between him/her and the Seller, also using the free assistance of the district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (including the Federation of Consumers, Association of Polish Consumers).

Personal data in the Online Store

  • The administrator of Customers' personal data collected via the Online Store is the Seller.
  • Personal data of Customers collected by the administrator via the Online Store are collected for the purpose of executing the Sales Agreement and, if the Customer consents, also for marketing purposes.
  • The recipients of the personal data of Customers of the Online Store may be:
    • In the case of a Customer who uses the Online Store's delivery method by post or courier, the Administrator makes the collected personal data of the Customer available to the selected carrier or intermediary carrying out the shipment on behalf of the Administrator.
    • In the case of a Customer who uses electronic payment or payment card payment in the Online Store, the Administrator makes the collected personal data of the Customer available to the selected entity handling the above payments in the Online Store.
  • The customer has the right to access and correct their data.
  • Providing personal data is voluntary, however failure to provide the personal data indicated in the Regulations and necessary to conclude the Sales Agreement results in the inability to conclude said agreement.

Final provisions

  • Agreements concluded via the Online Store are concluded in Polish.
  • The Seller reserves the right to make changes to the Regulations for important reasons, i.e.: changes in legal regulations, changes in payment and delivery methods - to the extent that these changes affect the implementation of the provisions of these Regulations. The Seller will inform the Customer of each change at least 7 days in advance.
  • In matters not regulated in these Regulations, the generally applicable provisions of Polish law shall apply, in particular:
    • Civil Code,
    • Act on the provision of services by electronic means,
    • Consumer Rights Act,
    • Personal Data Protection Act.
  • The customer has the right to use out-of-court complaint and claim settlement methods. For this purpose, they can file a complaint via the EU ODR online platform available at:
